Welcome to FunIsland Kids. By accessing our tropical island-themed entertainment park and using our facilities, you agree to be bound by these Terms of Service. These terms apply to all visitors, guests, parents, guardians, and children using our adventure zones, water attractions, and entertainment facilities. If you do not agree with any part of these terms, please do not use our services or enter our premises.

FunIsland Kids reserves the right to modify, update, or change these terms at any time without prior notice. It is your responsibility to review these terms periodically. Continued use of our facilities after any such changes constitutes your acceptance of the new terms.

2. Park Access and Admission

Access to FunIsland Kids is subject to availability and our operational hours. We reserve the right to refuse admission or remove any person from our premises for any reason, including but not limited to violation of park rules, unsafe behavior, or failure to comply with staff instructions. All visitors must check in at our reception area before entering any adventure zones.

Children under the age of 12 must be accompanied by a parent or legal guardian at all times. Parents and guardians are responsible for supervising their children and ensuring they follow all safety guidelines and zone-specific rules. While our staff provides supervision in designated areas, ultimate responsibility for child safety remains with the accompanying adult.

Age restrictions for specific zones are clearly marked and must be strictly observed. These restrictions are in place for safety reasons and to ensure age-appropriate experiences. Our staff has the authority to verify ages and redirect children to more suitable zones if necessary.

3. Safety Rules and Regulations

All visitors must comply with posted safety rules and instructions from FunIsland Kids staff members. Safety regulations vary by zone and activity, and it is the responsibility of each visitor to read, understand, and follow all applicable guidelines. Failure to comply may result in removal from specific zones or from the entire facility without refund.

For water attractions and splash zones, appropriate swimwear is required. Proper footwear must be worn in designated areas. Personal belongings should be stored in provided lockers, and FunIsland Kids is not responsible for lost, stolen, or damaged personal items.

Running, pushing, or rough play that may endanger others is strictly prohibited. Visitors must use equipment only as intended and demonstrated by staff. Climbing over barriers, entering restricted areas, or tampering with safety equipment is forbidden and may result in immediate expulsion from the premises.

4. Health and Medical Considerations

Visitors with medical conditions, physical limitations, or health concerns should consult with our staff before participating in any activities. Certain attractions may not be suitable for individuals with heart conditions, back problems, pregnancy, or other medical issues. It is the visitor's responsibility to assess their own health and fitness for each activity.

Parents and guardians must inform staff of any relevant medical conditions, allergies, or special needs their children may have. In case of medical emergency, FunIsland Kids staff will provide first aid and contact emergency services as necessary. By entering our facility, you consent to emergency medical treatment if required.

For the safety and health of all visitors, anyone showing signs of illness, including fever, vomiting, or contagious conditions, should not enter the facility. We reserve the right to ask visitors who appear ill to leave the premises to protect the health of other guests and staff members.

5. Liability and Assumption of Risk

By entering FunIsland Kids, visitors acknowledge that participation in playground activities, water attractions, and adventure zones involves inherent risks. While we maintain high safety standards and provide supervision, accidents can occur. Visitors participate in all activities at their own risk.

FunIsland Kids, its owners, employees, and agents shall not be liable for any injury, loss, damage, or accident that occurs on the premises, except in cases of proven negligence on our part. Parents and guardians assume full responsibility for injuries or damages caused by their children to themselves, other visitors, or property.

We strongly recommend that all visitors have appropriate personal insurance coverage. FunIsland Kids maintains liability insurance as required by Australian law, but this does not eliminate the inherent risks associated with recreational activities.

6. Behavior and Conduct

All visitors are expected to behave respectfully toward other guests, staff members, and property. Abusive language, threatening behavior, discrimination, or harassment of any kind will not be tolerated and will result in immediate removal from the premises with possible legal action.

Smoking, alcohol consumption, and illegal substances are strictly prohibited throughout the entire facility. Weapons, dangerous items, or anything deemed unsafe by our staff are not permitted on the premises. Security checks may be conducted at our discretion.

Photography and video recording for personal use are permitted, but visitors must respect the privacy of others. Commercial photography or filming requires prior written permission from FunIsland Kids management. Images or videos taken at our facility may not be used for commercial purposes without authorization.

7. Property Rights and Intellectual Property

All content, designs, logos, trade names, and intellectual property associated with FunIsland Kids are owned by or licensed to us and are protected by Australian and international copyright, trademark, and other intellectual property laws. Unauthorized use, reproduction, or distribution of any content from our facility or website is strictly prohibited.

FunIsland Kids retains ownership of all photographs, videos, or other media produced by our staff for promotional purposes. By entering our facility, you consent to being photographed or recorded for marketing and promotional use unless you explicitly opt out by notifying our staff.

8. Privacy and Data Protection

FunIsland Kids collects and processes personal information in accordance with Australian privacy laws and our Privacy Policy. By using our services, you consent to the collection, use, and storage of your personal information as described in our Privacy Policy, which is incorporated into these Terms of Service by reference.

9. Facility Operations and Closures

FunIsland Kids reserves the right to close the entire facility or specific zones at any time for maintenance, safety concerns, weather conditions, or other operational reasons. We are not liable for any inconvenience or expenses incurred due to temporary or permanent closures.

Operating hours and zone availability are subject to change without notice. We recommend checking our website or contacting us directly before planning your visit. Special events, private bookings, or capacity limitations may affect public access to certain areas or the entire facility.

10. Lost and Found

Lost items should be reported to our reception desk immediately. While we make reasonable efforts to secure lost property, FunIsland Kids is not responsible for lost, stolen, or damaged items. Unclaimed items in our lost and found will be held for a maximum of 30 days before being donated or disposed of.

We strongly recommend that visitors use provided lockers for valuable items and clearly label children's belongings with names and contact information. FunIsland Kids cannot be held responsible for items left unattended in any area of the facility.

11. Food and Beverages

Outside food and beverages may be subject to restrictions in certain zones for safety and hygiene reasons. FunIsland Kids provides designated eating areas where visitors may consume snacks and meals. Please dispose of all waste properly in provided receptacles.

Visitors with food allergies or special dietary requirements should notify our staff. While we make efforts to accommodate special needs, we cannot guarantee an allergen-free environment. Parents are responsible for monitoring their children's food consumption and ensuring safety regarding allergies.

12. Group Bookings and Events

Group bookings, birthday parties, and special events are subject to separate terms and conditions provided at the time of booking. Deposits may be required and are subject to our cancellation and refund policies. Group organizers are responsible for the behavior and safety of all participants in their party.

Special event bookings must be made in advance and are subject to availability. FunIsland Kids reserves the right to cancel or reschedule events due to unforeseen circumstances, with appropriate notice and alternative arrangements offered when possible.

13. Dispute Resolution

Any disputes arising from these Terms of Service or your visit to FunIsland Kids shall be resolved through good-faith negotiation. If direct resolution is not possible, disputes will be subject to mediation before pursuing legal action. All legal matters shall be governed by the laws of Queensland, Australia.

Visitors agree to attempt informal resolution of any complaint or concern by first contacting FunIsland Kids management. We are committed to addressing concerns promptly and fairly. Legal action should be considered only after exhausting reasonable efforts to resolve matters directly.

14. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
